Case research

Case research involves

  • Finding cases and decisions which have precedential mandatory authority or persuasive value in a jurisdiction with similar legal issues.

 

  • Determining how the holdings of those cases apply to the case at hand.

 

  • Determining that none of the cases cited have been reversed, overruled, or discredited.
